Socialization Regarding Director General Regulation Number 109 on the Appointment of Foreign Testing Institutes Together with SDPPI

Based on the evaluation results, a total of 108 National Laboratory Testing Institutes (BULN) have been granted continued recognition. This recognition is given to BULNs that have fulfilled all requirements and obligations, and their Test Result Reports (TRRs) have been used for certification purposes since the enactment of Director General Regulation 11/2021. On the other hand, 13 BULNs did not receive continued recognition. This is because their TRRs have not been used in the certification process since the enactment of Director General Regulation 11/2021 until now. Furthermore, the Directorate General of SDPPI cannot ensure the maintenance of testing competence of the respective BULNs. Additionally, there are 6 BULNs that have been removed but merged with other BULNs in their registration. This is part of the evaluation results of the BULNs conducted by the relevant authorities. Director General Regulation No. 109 of 2024 has established temporary recognition procedures for Foreign Testing Institutes (BULN) aimed at supporting the certification process of telecommunications equipment and devices in Indonesia. This recognition is divided into three main categories, with requirements and obligations to be complied with by the respective BULNs. In the general category, unilateral recognition of BULNs is implemented with a deadline until December 31, 2024. BULNs wishing to subcontract testing can only be accepted if the subcontract is made to BULNs also listed in the designated list. Additionally, periodic and ad hoc supervision will be implemented, and this policy revokes the previous Director General Regulation, namely Director General Regulation 11/2021. The criteria for Foreign Testing Institutes include the ability to conduct testing in accordance with Indonesian technical standards, accreditation ISO/IEC 17025 from accrediting bodies signed by APAC-MRA and/or ILAC-MRA, and having at least two other proofs such as accreditation from accrediting bodies of other countries, recognition from international conformity assessment bodies, or telecommunications administration recognition from other countries. The obligations to be complied with by BULNs include conducting testing in accordance with the applicable standards in Indonesia, attaching a summary of page references from TRRs to Indonesian technical standards as references, mandatory use of Electronic Signatures (E-Signatures) on TRRs, reporting to SDPPI two months before the accreditation expiration date, and reporting any changes occurring in the lab name, lab address, responsible person’s data, legal status, and other matters that may affect testing to SDPPI. In developing MRA partnerships (Mutual Recognition Arrangement), Indonesia follows a series of strategic steps consisting of several stages: The implementation of Director General Regulation No. 109/2024 has significant impacts on the testing process of electronic devices in Indonesia. Based on this regulation, Test Result Reports (TRRs) must be issued or tested in registered laboratories, regardless of their issue date. Additionally, the testing location and scope must align with the designated list of laboratories. However, subcontractor testing is still allowed as long as the subcontractor laboratory is listed in the recognized laboratory list. This regulation also prohibits field testing, such as at the device manufacturer’s factory. Furthermore, TRRs must be issued with Electronic Signatures (E-Signatures). Non-radio interface testing and laser safety testing must be conducted at National Testing Institutes (BUDNs). Moreover, the regulation mentions that there are some changes in the name and/or address of registered laboratories, so parties involved in the electronic device testing process are expected to take note of these changes.

The directorate has considered the results of polling evaluations regarding the validation method for applications, which have been conducted since January 24, 2024. Therefore, the Directorate of Standardization will conduct a trial related to application validation using the Queue method, with the following provisions: 1. The trial of the queueing method will commence on April 1, 2024. 2. Certificate applications should be submitted during the service hours for receiving certificate applications, from 08:00 to 11:00 AM WIB. 3. There is no limitation on the quota for receiving certification applications. 4. The number of applications processed per day is 60 applications or according to daily capacity. 5. Certificate applications will be processed within one business day (one day service) after the electronic issuance of the Receipt by the document inspection officer, marking the beginning of the service process. 6. Certificate applications that have not received a Receipt will be processed on the next business day. 7. Minister of Communication and Informatics Decision: Specific Absorption Rate Limitation for Telecommunication Devices

The government has taken significant steps to protect public health by announcing new decisions regarding Specific Absorption Rate (SAR) limitations on telecommunication devices, including mobile phones and tablet computers. This decision was made by the Minister of Communication and Informatics in response to growing concerns about the radiation effects of these devices. According to the issued decision, the set SAR limitations will be a crucial parameter that must be adhered to by telecommunication device manufacturers. SAR measures the level of electromagnetic radiation absorbed by the human body when using such devices. This step is expected to reduce the potential health risks associated with exposure to electromagnetic radiation from telecommunication devices. The telecommunication devices such as mobile phones and tablet computers referred to are used within a distance of less than 20 cm from the body and have a radiation power transmission of more than 20 mW (twenty milliwatts). The reference SAR value limitations in Indonesia will be based on the following references: The government has announced plans to implement mandatory compliance with Specific Absorption Rate (SAR) limitations on telecommunication devices, particularly mobile phones and tablet computers. According to the announced plan, the implementation of SAR limitation compliance will be divided into two phases: With the phased implementation, it is hoped that the telecommunications industry can adapt and ensure that the produced devices meet the established SAR standards. The obligation to comply with the Specific Absorption Rate limitation as mentioned above shall be effective for a maximum period of 2 (two) years from the date the obligation to comply with the Specific Absorption Rate limitation takes effect. Applicants for telecommunication device certificates are required to attach the following documents: By attaching the appropriate documents, it is hoped that applicants can meet the specified requirements and obtain certification for their devices. Applicants for telecommunication device certificates must submit the Specific Absorption Rate (SAR) test result report (TRR) for each certification letter from the Domestic Testing Institute to the Directorate of Device Standardization and Informatics, Ministry of Communication and Informatics, no later than 14 (fourteen) calendar days from the issuance date of the Specific Absorption Rate (SAR) test result report (TRR) as stated in the certification letter from the Domestic Testing Institute. In the event that based on the Specific Absorption Rate (SAR) test result report (TRR), telecommunication devices such as mobile phones or tablet computers do not comply with the SAR limitations as stipulated in this ministerial decision, the following provisions shall apply: Holders of telecommunication device certificates will be sanctioned if their devices violate the specific absorption rate limitations stipulated in this Ministerial Decision.
